The description of the goods you order will be as shown on the Gates and Accessories website at the time you place your order. We list all of our products as accurately as possible, but with so many different products and manufacturers subtly upgrading their products throughout the year there may be a few occasions when what you received is not 100% as described (but the difference will always be minimal and beyond our control). On such occasions we will always accept the return of goods, refund your payment in full and update the listing accordingly. The dimensions we quote are based on the information provided to us by the manufacturers but on occasions these can be inaccurate (particularly if the fitting has been remodelled) and so we recommend that you do not cut holes etc until you are in receipt of the goods and physically checked the dimensions. Please note that we do not accept any costs related to installation whether based on the dimensions quoted or not.
The terms of sale apply to all goods supplied by Climate Welding Ltd hereafter referred to as the Supplier.
If you require any additional information before ordering to confirm suitability please contact the Supplier in advance.
All goods are subject to availability. If we anticipate an unreasonable delay with the delivery of your order then we will contact you as soon as possible to offer a refund for any sum that has been paid.
No contract exists between you and the Supplier for the sale of any goods unit the Supplier has received and accepted your order and the Supplier has received payment in full. The contract is subject to your right of cancellation (see below).
Payment inclusive of delivery charges must be made in full before an order can be released. Payment shall be made by you without any deduction unless agreed in advance by the Supplier to you and processed via a valid discount voucher.
Delivery of the goods will be to the address given at the time of placing the order, subject to the Supplier offering a delivery service to the requested destination. The Supplier will seek to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery.
Please note that couriers do not call ahead before delivering and cannot normally be booked for a particular time, and they will also not leave your goods without a signature. They will however leave a card if you have missed a delivery and you can make alternative delivery arrangements.
If you are unable to check the contents of the package immediately upon receipt please reflect this on the paperwork. Failure to do so may affect any subsequent warranty claims.
When the order arrives you must check the goods for any damages or shortages. Claims for damaged goods and/or shortages have to be made within 7 days of receipt of your delivery. If you are able to notify the Supplier within 24 hours of delivery then this will help to expedite the replacement process. Claims for damages and/or shortages made after 7 days of your delivery arriving will not be accepted.
Please retain all of the packaging and the goods in a safe and dry environment is case you wish to return any part of your order.
By agreeing to the terms and conditions customers consent to receive invitations to review their orders
Returns – You may cancel the contract at any time up to the end of 14 Calender days after you receive the goods, providing the goods have not been fitted or modified in any way and providing they are returned with the original packaging and providing the goods are in a resalable condition. To cancel the contract you must contact the Supplier in writing. If you wish to cancel the contract after the goods have been dispatched the Supplier will issue you with a Returns Form which must be completed and accompany the return. Please note that you will be responsible for the safe return of the goods at your own expense. Goods returned as unsuitable will usually be changed for suitable ones, general returned goods are subject to a 15 – 20% restocking fee dependant on order value.
The goods must be returned to the registered address of the Supplier via a trackable means and within 14 days of receipt of the returns form. Once the goods have been returned or for orders not dispatched, the Supplier will refund you within 30 days. If you fail to return the goods as required, the Supplier may charge you a sum not exceeding the direct costs of recovering the goods.
Installation – Any installation / fitting of goods purchased from Climate Welding Limited must be carried out by a qualified electrician. Failure to do so will invalidate your warranty and may be in breach of the current building regulations
Warranty – All goods supplied are warranted free from defects for 12 months from the date of supply (unless otherwise stated) This warranty does not affect your statutory rights as a customer. The warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the suppliers instructions, or any alteration or repair carried out without the Suppliers approval. Any goods returned for a warranty claim that are found to not be faulty or subject of misuse, which includes incorrect installation will be returned to the customer at their cost.
Limitation of Liability – The Suppliers total liability in contract, tort (including negligence or breach of statutory duty) misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the agreement shall be limited to the price paid for the goods. Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by the Suppliers negligence or fradulent misrepresentation. Under no circumstances will the Supplier be held responsible for additional electrician or any other contractor fees that arise because of but not limited to late, damaged or incorrect delivery of goods. You should not book an electrician or any other contractor in advance of delivery.
Date Protection – The supplier will take all reasonable steps to keep the details of your order and payment secure but unless the supplier is negligent, the supplier will not be liable for unauthorised access to infomation supplied by you. See the section on PRIVACY POLICY.
Applicable Law – These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract.
